Acceptance
WoS Atlas ("WoS Atlas", "we", "us") is an independent sole-proprietor project that operates wosatlas.com ("the Atlas"). By using the Atlas, you agree to these terms. If you do not agree, please do not use the site.
Eligibility
You may use the Atlas only where doing so is lawful for you, and you are responsible for any rules that apply to you, including the game publisher's own terms.
You must be at least 13 years old to create an account. If you are under the age of majority where you live, you need the permission of a parent or guardian to create an account or make a purchase.
You must be at least 16 years old to make a paid purchase.
What the Atlas provides
The Atlas is an unofficial fan website that shows recorded Whiteout Survival information — the world map, players, alliances and each State — and offers live lookups of current game information on request. Recorded data may be incomplete, delayed or wrong. It is provided as a convenience for players with no guarantee of accuracy, completeness, availability or timeliness, and features may change or stop at any time.
Accounts
An account is free. Some features need one, such as saved favourites, notifications, support tickets, live lookups and purchases. You are responsible for keeping your password secure and for what happens under your account.
Do not create accounts in bulk or automate against the sign-in endpoints. We may suspend or remove an account that is used abusively. You may ask for your account to be deleted at any time — see the Privacy policy for what that removes and how to ask.
Linking a game account
You may link a Whiteout Survival account to your WoS Atlas account by proving you control it: we ask you to set one field in the game to a short phrase, and we check for it. Link only a game account that is yours. We never ask for your game login or password. Some features and purchases need a linked game account, and we may refuse or remove a link that appears not to belong to you.
Paid features
Some features can be paid for. Everything paid is a digital service delivered on this website:
- Live lookups — reads of current game information that you request on the website, such as where a player's base is right now. What a lookup costs is taken from the balance on your account when the request is accepted.
- Passes — access to deeper recorded data on the website for the period shown before you get one. A pass does not renew and never charges you again; when its period ends, it simply ends.
A purchase is added to your account automatically once its payment completes, and is used only on wosatlas.com. Nothing is delivered inside the game: no items, no game currency, no game accounts, no keys and no downloads, and nothing you buy changes anything in the game itself.
Lookups are prepaid use of the WoS Atlas service. They have no cash value, and your balance is not money, a voucher or a stored-value product: it cannot be exchanged for cash, transferred or gifted to another account, or used anywhere but this website. Balance received for free, such as from invites or from linking a game account, may be removed if it was obtained by abuse.
Prices are shown in US dollars before you buy. Depending on where you live, tax is either included in the price or added at checkout, and checkout shows the full total, and the currency you will pay in, before you pay.
Buying may be unavailable, limited or paused at any time, and a paid feature may be changed or paused.
Payment processing
Paid purchases are processed by Paddle, which acts as the merchant of record: Paddle sells the purchase to you on our behalf, takes the payment, issues the receipt and handles the tax. Paddle's own checkout terms and privacy policy apply to the payment. We never receive or store your full card or payment details.
Refunds and chargebacks
Refunds follow the Refund Policy. A refund takes back what the purchase added; lookups already used are owed, repaid from later lookups, and cleared if still owed 90 days after the refund. New purchases are paused on the account and on its linked game account while such lookups are owed, for 90 days after refunding a pass used for more than 2 days, and after a dispute or chargeback until support reviews it.
Acceptable use
- Do not use the Atlas to harass, dox, or endanger any person.
- Do not attempt to disrupt, overload, or break into the service.
- Do not scrape or automate against the site in a way that degrades it for others.
- Do not sell, share or trade WoS Atlas accounts or balances, and do not link a game account that is not yours.
- Do not use the Atlas for any unlawful purpose.
Suspension
We may suspend or close an account, remove a game-account link, or pause purchases where these terms are broken, where an account is used for abuse or fraud, or where a payment is disputed.
Game names and content
Whiteout Survival and all related names, logos, and game content are the property of Century Games and other respective owners. The Atlas is an unofficial fan project and claims no ownership of that material; it is referenced only to identify the game the data relates to.
No warranty
The Atlas is provided "as is" and "as available," without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement.
Limitation of liability
To the fullest extent permitted by law, WoS Atlas will not be liable for any indirect, incidental, or consequential damages arising from your use of, or inability to use, the site.
To the fullest extent permitted by law, the total cumulative liability of WoS Atlas to you for all claims arising out of or related to the Atlas or these terms is limited to the greater of USD 100 or the total you paid for purchases on the Atlas in the 12 months before the event giving rise to the claim. This limit reflects an allocation of risk between you and us, is an essential basis of the terms on which the Atlas is offered, and applies even if a limited remedy fails of its essential purpose.
Nothing in these terms limits any rights you have under consumer law that cannot be limited or excluded.
Indemnification
You agree to defend, indemnify and hold harmless WoS Atlas against any claims, liabilities, damages, losses and expenses, including reasonable legal fees, arising out of or related to:
- Your use or misuse of the Atlas.
- Your breach of these terms, including the Acceptable use rules.
- Your violation of any law or of the rights of any third party, including the terms of service of any game publisher.
Governing law and venue
These terms, and any dispute arising out of or related to them or to the Atlas, are governed by the laws of the Commonwealth of Massachusetts, USA, without regard to its conflict-of-laws rules. Any dispute that is not subject to arbitration under the Arbitration and class-action waiver section must be brought only in the state or federal courts located in Massachusetts, and you and we both agree to the personal jurisdiction of those courts.
Arbitration and class-action waiver
Before starting arbitration, the side bringing a claim must first send the other a written notice describing it and give the other side a good-faith opportunity of at least 30 days to resolve it informally. Send notice to us at support@wosatlas.com.
If the dispute is not resolved within that period, you and we agree that any dispute, claim or controversy arising out of or related to these terms or the Atlas will be resolved by binding arbitration on an individual basis, administered by the American Arbitration Association under its Consumer Arbitration Rules, with the seat of arbitration in Massachusetts, USA. Judgment on the award may be entered in any court with jurisdiction.
Instead of arbitration, either side may bring an individual claim in small-claims court if the claim is within that court's jurisdiction.
You and we may each bring claims against the other only individually, and not as a plaintiff or class member in any class, collective, consolidated or representative proceeding. An arbitrator may not combine more than one person's claims or preside over any form of class or representative proceeding.
Nothing in this section waives rights that cannot be waived under mandatory law, including any non-waivable rights under the Massachusetts Consumer Protection Act (M.G.L. c. 93A) and under the mandatory consumer protection law of the country or state where you live. If the mandatory law where you live does not allow binding arbitration agreed before a dispute, or a class-action waiver, for the kind of claim you bring, those protections apply to you, and the parts of this section that conflict with them do not apply, to the extent of that conflict.
Severability
If a court or arbitrator with jurisdiction finds any part of these terms invalid, illegal or unenforceable, that part will be enforced to the greatest extent the law allows and the rest of these terms stay in full effect. If the class-action waiver is found unenforceable for a particular claim, only that claim is taken out of arbitration and brought in court; the rest of the Arbitration and class-action waiver section still applies to every other claim.
Changes
These terms may be updated from time to time. The "last updated" date above reflects the current version, and continued use of the site means you accept the revised terms.
